This is the second "no-subdivide" easement NCLT
has worked on. The Phillips family wanted to split their
8-plus acre parcel to enable future sale and development
of the newly created vacant parcel. However, the new parcel
would have been eligible for a potential additional split,
which the County would not allow due to terrain conditions.
One of the alternatives to solve this problem, the establishment
of special zoning to prevent future development, would have
been very costly and time-consuming. The alternative they
chose was to cover the land with a conservation easement
prohibiting future lot splits. This solution allowed their
split to proceed and was very cost efficient. The easement
is recorded and runs with the deed.
